Death only for some

I want to make sure I understand. The Washington state Supreme Court struck down the death penalty. The Washington state Senate has voted to remove the death penalty. The governor has said that he would sign the measure if it comes to his desk. So if this vote passes, a convicted guilty murderer will not receive the death penalty, but the death penalty will still be legal for an innocent, unborn child. Am I missing something?
