Chuck Winder, sponsor of SB 1165, that raise questions about the constitutionality of his bill, SB 1165, to ban abortions after 20 weeks gestation on grounds of fetal pain. "Section 5 of the Act is unconstitutional under the Fourteenth Amendment to the United States Constitution insofar as it proscribes some non-therapeutic abortions even before a fetus has reached viability," states the first opinion, issued before the bill's introduction.
